BILL NUMBER:A8339A
Title of bill
An act to authorize the Ethical Humanist Society of Long Island, to file an application for a real property tax exemption
Purpose or general idea of bill
To exempt the Ethical Humanist Society of Long Island from liability for payment of certain real property taxes for property owned by the Ethical Humanist Society of Long Island in the Town of Hempstead, Nassau County, New York.
Summary of specific provisions
Section 1 grants the assessor of the county of Nassau to accept and, at his or her discretion, grant, an exemption from real property taxes to the Ethical Humanist Society of Long Island, pursuant to Section 420-a of the Real Property Tax Law, for a parcel of land owned by such entity in the Town of Hempstead. If satisfied that the Ethical Humanist Society would otherwise have been entitled to said exemption, the assessor upon approval of the Nassau County Legislature, is authorized to grant such exemption from all taxa- tion beginning with the date of acquisition of the property. This bill would further provide that the governing body or tax department may, in its sole discretion, provide for the refund of those taxes paid and cancel taxes, fines, penalties or interest remaining unpaid. Section 2 provides for an immediate effective date.
Existing law
Existing law authorizes tax exemptions be granted after the taxable status date has passed if a bill is chaptered authorizing an assessor to accept a late application
Justification
The Ethical Humanist Society of Long Island owns a parcel or real property located in the town of Hempstead, Nassau County for the purpose of operating a church. It is intended by this bill to undo the hardship that will be suffered by the Society if they are required to pay the property taxes due as described above.
