BILL NUMBER:A8387A

Title of bill

An act in relation to creating a sustainable energy loan program in the town of Bedford

Purpose or general idea of the bill

This legislation is intended to reduce energy costs and greenhouse gas emissions as well as make energy efficiency and renewable energy improvements more affordable to homeowners and businesses within the town of Bedford. Accordingly, it authorizes the town of Bedford to offer sustainable energy loans to help homeowners and businesses within the town finance the installation of distributed generation renewable energy sources (energy that is generated close to the point of use) and/or energy efficiency improvements.

Summary of specific provisions

Section 1 of the bill provides that it is the intent of the town of Bedford to promote energy efficiency among its residents and businesses, including the promotion of energy efficiency improvements and the utili- zation of renewable energy sources in existing buildings within the town.

Section 2 of the legislation provides definitions of "distributed gener- ation," "renewable energy source" and "energy efficiency improvement." It also authorizes the town of Bedford to offer, in its discretion, sustainable energy loans to help its homeowners and businesses finance the installation of distributed generation renewable energy sources and/or energy efficiency improvements. This section also authorizes the town to use monies made available for the program from federal grants to implement the sustainable energy loan program. The loans issued by the town under this program will be repaid by the borrower through an assessment levied by the town on the real property where the sustainable energy loan was applied. The total amount of each such loan provided by the town cannot exceed the actual cost of the equipment and the materi- als necessary for the installation of distributed generation renewable energy sources or the energy efficiency improvements.

Section 2 provides further that the town of Bedford declares that this legislation is necessary for the immediate protection of the public interest and for the implementation of the energy efficiency and green- house gas reduction plans of the town and the state of New York.

Section 3 provides the effective date, which is immediate.

Justification

To address the issue of global climate change and greenhouse gas emis- sions in the town of Bedford, the town has embarked on an effort to reduce energy demand from existing buildings to allow the town to meet statewide energy efficiency goals. To assist residents and businesses within the town by making energy efficiency improvements more affordable and to promote the installation and utilization of these improvements,

it is necessary to create a program to help finance the cost of these energy efficiency improvements.
