BILL NUMBER:A8527
Title of bill
An act to amend the election law, in relation to ballots which are counted by machine; to amend the election law, in relation to paper ballots; and to repeal section 8-310 of such law, relating to paper ballots
Purpose or general idea of bill
This bill amends the election law to reflect the transition from a limited use of paper ballots to the full use of paper ballots with new voting machines statewide.
Summary of specific provisions
Section 1 of the bill amends the election law to provide that paper ballots may be printed and arranged in a manner that allows them to be counted by a voting machine approved by the state board of elections.
Section 2 of the bill repeals section 8-310 of the election law which reflects the current limited use of paper ballots that contain numbered stubs and must be folded before delivery to the voter.
Section 3 of the bill provides that paper ballots used with optical scan voting systems or intended to be counted by hand pursuant to election law § 7-200(1) shall be delivered to the voter in a manner consistent with state board of elections rules and regulations.
Section 4 contains the effective date.
Justification
New voting machines will begin to be used in most of the counties outside of New York City beginning in September 2009. These machines will all use paper ballots. In contrast, election law 7-200(1) currently only permits elections to be held solely by paper ballot when there are less than 1000 people voting in that election and election law § 8-310 provides the procedures for doing so. The bill amends the election law to reflect the new procedures that will be used to deliver paper ballots to voters for use with the new optical scan voting machines while preserving the ability to use and count the same paper ballots by hand when there are less than 1000 voters in an election.
