BILL NUMBER:A8676

Title of bill

An act to amend the environmental conservation law, in relation to authorizing deposit initiators or distributors to count empty containers by mechanical process at a location other than the redemption center or dealer's place of business

Purpose or general idea of bill

Provides that a deposit initiator or distributor to count empty containers by mechanical process at a location other than the redemption center or dealer's place of business.

Summary of specific provisions

1. Paragraph (b) of subdivision 8 of section 27-1007 of the environmental conservation law, as added by section 4 of part SS of chapter 59 of the laws of 2009, is amended.

Justification

Under the provisions of the recently enacted law, deposit initiators and third party agents are prohibited from counting empty containers off the premises of the retailer. While recognizing the intent of the statute to protect retailers from undercounting the unin- tended effect of the law precludes third party agents from effectively and efficiently serving their urban retail customer base through use of their automated container sorting equipment. A system which permits retailers to commingle empty containers thereby reducing labor and stor- age demands.

Effective date
