BILL NUMBER:A8776
Title of bill
An act to amend the general municipal law, the town law, the village law and the local finance law, in relation to consolidating or dissolving fire districts
Purpose or general idea of bill
This legislation provides an exemption for fire districts under "The New N.Y. Government Reorganization and Citizen Empowerment Act."
Summary of specific provisions
Sections 1 through 7 amend the general municipal law, the town law, the village law, and the local finance law in relation to providing an exemption to fire districts from consolidat- ing or dissolving certain local government entities, as proposed in legislative bills A.8051/S.5661 of 2009.
Section 8 provides that the bill shall take effect on the same date and in the same manner as a chapter of the laws of 2009.
Justification
In 2009, Speaker Silver introduced A.8501/S.5661 a Department of Law Program Bill, entitled "The New N.Y. Government Reor- ganization and Citizen Empowerment Act," which created requirements for consolidating or dissolving certain local government entities with the exception of school districts, city districts, or special purpose districts created by counties under county law. This bill would provide fire districts with an exemption from such consolidation or dissolution. Without such an exemption, the impact of "The New N.Y. Government Reor- ganization and Citizen Empowerment Act" on fire districts could be devastating to the communities that rely on the vital services that volunteer firefighters provide.
If legislative changes are made that adversely impact the State's volun- teer firefighting system, the only alternative would be a paid system that would cost taxpayers more than the current volunteer-based system.
Furthermore, there is currently a method for dissolving or consolidating fire districts provided in the Town Law. This process allows real prop- erty owners and the Town Board to determine the necessity and implement such consolidation or dissolution.
