BILL NUMBER:A8892

Title of bill

An act to amend the alcoholic beverage control law, in relation to the issuance of permits authorizing institutions of higher education to deliver or cause to be delivered alcoholic beverages to a person who is at least twenty-one years of age enrolled in a course or courses approved by the institution of higher education and conducted by an instructor or instructors engaged by the institution of higher education

Purpose or general idea of the bill

The purpose of this bill is to enable New York State institutions of higher education to obtain special permits to exempt schools and educators from the alcoholic beverage law, provided that a person's tasting or imbibing such alcoholic beverages is based on instructional purposes, by those who are enrolled in a class or course of classes authorized by the institution of higher education.

Summary of provisions

Section 1 of this bill would allow an institution of higher education operating under authority granted by the State Education Department, to deliver or cause to be delivered alcoholic beverages to a person who is at least twenty-one years of age in connection with the teaching by an instructor of a single course consisting of a single class or any and all courses held during the academic calendar year.

Section 2 of the bill would allow an institution of higher education issued a permit in accordance with this section to purchase alcoholic beverages from premises licensed to sell liquor at retail for consumption off the premises.

Justification

This special category is expressly formatted for educators and course work within the higher education community. Alcoholic beverages are sometimes necessary to ensure that students are getting the most information regarding their education, especially in areas of culinary, cultural and agricultural contexts. With the assistance of the State Liquor Authority, the legislature feels that access to alcoholic beverages for educational purposes should be provided and can be responsibly delivered.
