BILL NUMBER:A9058

Title of bill

An act to amend the education law, in relation to enacting the "school budget vote fairness act"

Purpose or general idea of bill

This bill would require school districts to maintain a contingency budget that is no more than either 120 percent of the Consumer Price Index (CPI), four percent or one percent below second proposed budget whichever is less.

Summary of specific provisions

Section 1 provides the short title of this bill known as the "School Budget Vote Fairness Act."

Section 2 amends the Education Law by adding language to limit a contingency budget increase to no more than either 120 percent of the Consumer Price index (CPI), four percent or one percent below the second proposed budget whichever is less.

This section further states that a school district cannot adjust their original budget estimates when determining a contingency budget.

Section 3 provides the effective date.

Justification

School property tax relief is a key ingredient to easing the tax burden on New York's families and businesses and this proposal sets out to address it. School districts throughout the State have threatened school district voters prior to a school district vote that a contingency budget will be higher than the original proposed budget. This is due mainly to statutory budget exclusions that have been enacted to accompany the contingency cap.

Specifically, there have been occasions where school districts have adjusted their original proposed budget projections under a contingency budget cap and allowed the school district to increase their contingency budget above the original proposed budget and the statutory contingency cap. This bill will require school districts to limit a contingency budget increase to no more than either 120 percent of the Consumer Price index (CPI), four percent or one percent below the second proposed budget whichever is less.
