BILL NUMBER:A9074 REVISED 09/03/09

Title of bill

An act to amend the public health law, in relation to establishing a state-wide database on the location and availability of medical proce- dures

Summary of specific provisions

Section 1. Amends subdivision 1 of section 2995-b of the public health law by adding a new paragraph (d) which establishes a state-wide data- base of all medical procedures performed in hospitals in New York State that lists each procedure and information on which hospitals are equipped to perform it.

Section 2. Amends section 2995-b of the public health law to add subdi- visions 4 and 5 which require that the Department of Health provide electronic access to the state-wide database of medical procedures performed in hospitals and that this information is available on the Department of Health website. Furthermore, the Department of Health is instructed to promulgate and rules and regulations necessary for the implementation of the database.

Section 3. Effective date

Justification

Establishing a state-wide database would help to ensure that when there is a crucial medical emergency, doctors will know immediately the best place to send an injured patient for proper medical treatment. Having an established database which shows hospital locations that are medically equipped and doctors who are able to perform specific procedures will allow for the best possible outcome for the patient. There is currently no state-wide database that enables doctors or patients to see which hospitals in New York State can perform specific procedures. Time sensi- tive emergency situations, such as the accidental severing of a digit or a limb, require having the appropriate personnel and equipment right away. It is imperative to have the knowledge on where to receive correct medical attention.
