BILL NUMBER:A9083A

Title of bill

An act authorizing the beneficiary of Robert Carballeira to receive an enhanced pension benefit on his behalf

Purpose or general idea of bill

Allows the beneficiary of the late Robert Carballeira, who was a member of the New York State and Local Employees Retirement System and employed by Suffolk County, to claim a benefit including ail the credit from his original retirement and subse- quent retirement.

Summary of specific provisions

Section 1 allows the beneficiary of Robert Carballeira to receive a benefit based on the total service cred- it to which he was entitled at the time of his earlier retirement on August 30, 1997 including all credit received under the 1997 retirement incentive, in addition to all member service credit earned by him subse- quent to his last restoration to membership on March 1, 2003. Also, requires the beneficiary of Robert Carballeira to file an application with the State Comptroller by December 31, 2009.

Section 2 requires that all costs associated with this act be borne by Suffolk County.

Section 3 contains the effective date.

Justification

Robert Carballeira was employed by the Suffolk County Department Of Public Works until he retired under a retirement incentive offered in August 1997. Mr. Carballeira returned to employment with the County in March of 2003 and restored his membership in the New York. State and Local Employees Retirement System. At this time his pension payments stopped. This legislation is necessary to ensure that the bene- ficiary of the late Robert Carballeira receives a benefit that reflects all the service credit he earned without requiring payment to the Retirement System for any benefit already received.
