BILL NUMBER:A9198
Title of bill
An act in relation to prohibiting the issuance of permits to operate, construct or develop slaughterhouses within a fifteen hundred foot radius of a residential dwelling
Purpose of the bill
This bill will prohibits the construction of a slaughterhouse within fifteen hundred feet of a residential home.
Summary of provisions
Section 1 of the bill states that, on and after November 1, 2009, no building permit or approval applying to the devel- opment of real estate shall be issued to any person or corporation to operate, develop or construct any commercial slaughterhouse if any portion of the facility is within a fifteen hundred foot radius of a residential dwelling.
Subdivision (b) of the bill states that the provision of this act shall not apply to any premises that have been continuously conducting busi- ness from a date prior to the effective date of this act.
Subdivision (c) of the bill states that this act relates to all real estate development permits and approvals issued on or after November 1, 2009.
Subdivision (d) of the bill states that the provision of the act shall not apply to New York City.
Subdivision (e) of the bill relates to the definition of "authority of state and local law".
Justification
Slaughterhouses have many negative environmental impacts including odor, air pollution, sludge and wastewater. Water usage can rise upwards of 200,000 gallons a day taxing nearby wells. The wastewa- ter and sludge from these plants consist of feces, blood and other potentially dangerous materials that could contaminate nearby residences and communities.
In order to prevent these facilities from being placed imprudently in residential New York City communities, the State passed a law in 2008 that put a 4 year moratorium on licensing low capacity slaughterhouses that are placed within 1,500 feet of a residence in the City of New York. This law goes further to prohibit the construction, development and operation of all slaughterhouses, including large industrial facili- ties, located within 1,500 feet of a residence throughout the rest of New York State. This bill is more necessary as it applies to larger slaughterhouses that have greater and more devastating environmental consequences on neighboring communities. This bill will not affect facilities that are already in existence.
