BILL NUMBER:A9203A
Title of bill
An act to amend the penal law, in relation to criminal sale of a controlled substance upon the grounds of a library
Purpose
creates a drug-free zone in and around (within 1000 feet) of a public library or association library.
Summary of provisions
Section 1 adds a new Section 220-61 to the penal law that a person is guilty of criminal sale of a controlled substance upon the grounds of a library when he or she sells a controlled substance,
Section 2 on the grounds of a public library or association library shall mean in, on or within any building, parking lot or land and any area accessible to the public within one thousand feet of the real prop- erty line comprising the library.
Existing law
Current law provides for Drug Free Zones in, on or within any public schools or within 1000 feet. No current law for Drug Free Library Zones.
Justification
Our libraries, like our schools, service children and young adults. Ensuring Drug Free Zones around Libraries is another step toward protecting these children when they are frequenting the Library.
