BILL NUMBER:A9223C

Title of bill

An act to amend the general business law, in relation to prohibiting the sale of unsafe cribs

Purpose or general idea of bill

It is the intent of this legislation to ensure the protection of the State's youngest and most vulnerable from the dangers associated with crib malfunctions. The purpose of this act is to ban the sale of unsafe cribs.

Summary of specific provisions

The general business law is amended by adding a new section 399-I which will prohibit the import, manufacture, distribution and sale of drop-side and other unsafe cribs, which are defined as any crib that does not meet the current ASTM International crib standards or the standards contained in Title 16 of the Codes of Federal Regulations applicable to cribs. The penalty for violating this law will be a civil penalty not to exceed one thousand dollars for each violation.

Justification

Unsafe cribs pose an unacceptable risk of injury to young children. One example of an unsafe crib that has been the subject of several recent investigations and recalls are drop-side cribs. Drop-side cribs have more moving parts than cribs with four fixed sides, leading to an increased risk of separation of one side of the crib from the others and higher rates of other crib malfunctions. Frequently, parents are unaware that their drop-side crib has become unsafe because the crib's hardware malfunctions in a way that is not easily detected.

Malfunctioning drop-side cribs have been the cause of at least three infant deaths and many injuries throughout the United States in the past eighteen months. One fatality occurred in Suffolk County and has already led the Suffolk County Legislature to prohibit the sale of drop-side cribs in Suffolk County.

The injuries and deaths resulting from the use of drop-side cribs have resulted in increased investigations and five recalls by the federal consumer product safety commission. This has led to a recall of more than three million cribs. The crib-making industry has proposed banning the manufacture and sale of drop-side cribs. However, this ban is only voluntary and is not required by any laws or regulations. It is the intent of this legislation to ensure the safety of the children of New York State from the dangers associated with drop-side crib malfunctions and other crib malfunctions by means of banning their manufacture and sale at-all outlets, including thrift stores and secondhand Stores.
