BILL NUMBER:A9521
Title of bill
An act requiring the state fire prevention and building code council to implement rules and regulations regarding the maple industry
Purpose or general idea of bill
To require the state fire prevention and building code council to expand the definition of agricultural buildings to include maple production facilities and sugarhouses, and allow such entities to provide for public access and assembly as an agritourism activity
Summary of specific provisions
Section 1 (a) of the bill amends the state building code definition of agricultural buildings to include maple production facilities or sugarhouses to ensure that such facilities are included in code exceptions related to agricultural buildings. Section 1 (b) amends the fire prevention and building code to allow for public access and assembly in sugarhouses as an agritourism activity.
Justification
New York State is consistently among the top three maple producing states in the nation, and with more tappable maple trees than any other state or Canadian province there is significant opportunity for growth.
Recommendations made by the New York State Maple Task Force for improving the state's maple industry include amending the definition of agricultural building to include maple production facilities or sugarhouses to enable maple producers to avoid unnecessary administrative barriers when building such facilities. In addition to amending the building code, this bill will allow maple producers to open their establishments to tourists as a way to promote maple sugar/syrup production and offer their products for sale and sampling.
