Justification

This legislation allows localities affected by flooding the option to participate in the "flood assessment relief act " and therefore make adjustments to the 2009 real property tax rolls and issue refunds. After the flooding in August of 2009, in Western New York, several counties were designated as both Federal and State disaster areas. Many homes were totally destroyed or heavily damaged due to the record flooding, consequently, many residents found themselves homeless or with extensive property damage. As a result of the damage, these properties are valued at much less Than the tax records would reflect. This legislation would allow these properties to be reassessed to reflect the value of their property after flooding. Similar legislation was signed into law in 2007.

Prior legislative history

This is new legislation.

Fiscal implications

To be determined.

Effective date

This act shall take effect immediately and shall be deemed to have been in full force on and after June 1, 2009.
