BILL NUMBER:A9835
Title of bill
An act to amend the state finance law, in relation to the environmental protection fund
Purpose
This bill would modify the repayment provisions of the Environ- mental Protection Fund (EPF) to include a definition of "sufficient moneys."
Summary of provisions
This bill would:
*remove the requirement that a finding of insufficient funding ,would require the Division of Budget to certify that the FIT cannot meet actu- al and anticipated disbursements; and,
*define the term "insufficient" to Mean that there is not an adequate cash balance to finance all current fiscal year appropriations and any outstanding prior year obligations; and,
*authorize the Comptroller to transfer moneys from the General Fund to the EPF upon a finding that moneys in the EPF are insufficient
Justification
The Environmental Protection Fund is New York State's primary vehicle for financing conservation efforts. EPF funds support programs such as municipal parks, waterfront revitalization, municipal recycling, open space land acquisition, and non-point source pollution control. The EPF contributes to farmland protection, wastewater treat- ment projects, invasive species management and ocean and Great Lakes protection initiatives.
Over the years, EPF funds have been redirected to support spending else- where in the budget. When this occurs, the EPF is unable to meet its obligations and critical commitments to areas such as the environment, pollution control, and invasive species management go unmet.
This legislation would establish a mechanism by which funds which are allocated to the EPF but subsequently spent elsewhere will be returned to the EPF to meet its obligations.
