BILL NUMBER:A9964

Title of bill

An act to amend the public officers law, in relation to requiring the head official of a law enforcement department to enforce a special schedule on Memorial day and Veterans' day that allows law enforcement officers, who are veterans entitled to paid leave, to take such leave

Purpose or general idea of bill

Amends the public officer's law, in relation to requiring the head official of a law enforcement department to enforce a special schedule on Memorial Day and Veterans' Day that allows law enforcement officers, who are veterans, entitled to paid leave, to take such leave.

Summary of specific provisions

The head official of any law enforcement department or agency shall make every practicable effort to ensure that any member of his or her law enforcement department or agency shall be allowed to take such paid leave of absence. Such official shall plan and enforce a schedule on such public holiday which shall utilize those members of his or her law enforcement department or agency who are not veterans, before scheduling those members entitled to such paid leave for such public holiday.

Justification

Current law allows for a paid holiday for veterans on Memorial Day/Veterans Day. The law includes an exception where such action would endanger the public safety or health of personnel cared for by the state, then a veteran would be required to work and take another day off as holiday pay. This bill would require that the public employer make every effort to schedule non-veterans to work these holidays before requiring a veteran to work on his or her holiday.
