Title of bill
An act to amend the social services law, in relation to providing for the regulation, supervision and inspection of "motels" for-profit in cities of one million or more persons which provide temporary or permanent places for homeless persons and receive state financial assistance
Summary of bill
This act amends subdivision 21 of section 2 of the social services law, as amended by chapter 770 of the laws of 1986.
The purpose of this act is to regulate the "motels," which serve to harbor the homeless, in relation to defining them under "adult care facilities" and, thereby, subjecting them to the inspection and supervision of the Commissioner of Social Services. This act will subject the construction and location of these "motels" to land use review procedure, which requires input of the community in which the motel is to be located.
Justification
The financial incentives provided by state programs to encourage construction and maintenance of temporary and permanent housing for homeless persons, and financial assistance provided to such persons, have the unintended effect of stimulating unregulated motels for-profit to spring up allover and take advantage of such incentives. They are providing insufficient care and facilities for those they were created to serve and shelter.
Fiscal implications
None.
Effective date
This act shall take effect on the one hundred twentieth day after it shall have become a law.
