Title of bill

An act to amend the election law, in relation to providing a mechanism for rendering and keeping confidential the voter registration information of certain law enforcement officials

Purpose

Allows law enforcement officials to apply for a court order making all voter registration information pertaining to the applicant confidential.

Summary of specific provisions

The Election Law is amended by adding new sections 5-217, 11-303 and 16-120 and amending section 9-209.

Justification

Law enforcement officials risk their lives on a daily basis to keep order in the society, and improve the quality of life for all of us by working to get persons who pose a danger to life and property off the streets and in the appropriate institutions or facilities. Often, these individuals blame the law enforcement official for all of their problems, subjecting those officials to threats of, and, actual physical violence. unlisted phone numbers are a useless tool if the information that is not in the phone book is available for the asking at the local board of elections. This bill would allow those law enforcement officials who desire to do so, to obtain a court order which would prevent the release of personal, identifying information kept by the board of elections to anyone except another board of elections or a governmental agency. Law enforcement official has been narrowly defined to include only those persons who, to a substantial extent of their time, are engaged primarily in the enforcement of criminal laws, whether state or federal.

Fiscal implications

None.

Effective date

This act shall take effect the first of January next succeeding the date it shall have become a law.
