Title of bill

An act to amend the executive law, in relation to prohibiting price differences for the same service based upon gender

Purpose or general idea of bill

To make it an unlawful discriminatory practice for any individual, firm or corporation to charge a different fee or price for the same service based solely upon the gender of the recipient. This bill does not restrict different prices based on gender if the service rendered is more difficult or more costly.

Summary of specific provisions

Section 296 of the executive law is amended to add a new subdivision 20 to provide that it will be an unlawful discriminatory practice for any person, firm or corporation to charge a different fee or price for the same service based solely upon the gender of the recipient, unless the services rendered are more difficult or costly for one sex than for the other. Anyone found in violation of these provisions will be subject to a fine of one thousand dollars or an amount up to three times the actual damages and legal fees whichever is greater.

Justification

As a result of historic patterns of discrimination, women in New York often pay more for the same services than men. Gender based discrimination in pricing commonly occurs in the sale of services related to: haircuts, laundry, dry cleaning and alterations. In the New York City Commissioner's Study, "Gypped by Gender", (June 1992), it was found that women were charged 27.3% more than men to launder and press a basic white, cotton shirt. It was further found that women paid 25% more at hair cutters for a basic shampoo, cut and blow dry. California recently passed legislation prohibiting businesses from discriminating with respect to the price charged for similar services, based upon gender.

Fiscal implications

None to the state.
