Purpose or general idea of bill
This bill authorizes Cattaraugus County to impose an additional 25 cents per $100 mortgage recording tax.
Summary of specific provisions
Section 1 amends the tax law by adding a new Section 253-x which describes the manner in which the additional mortgage recording tax is collected and lays out all requirements of the new section.
Section 2 says that this act shall take effect immediately and shall expire and be deemed repealed on December 1, 2012.
Justification
The Cattaraugus County Legislature, by Resolution Act Number 618-2008, adopted on November, 25 2008, has requested that the New York State Legislature authorize Cattaraugus County to impose an additional 25 cent mortgage recording fee. Cattaraugus County is anticipating difficulties in municipal finances and feels that they should have the same option for the mortgage recording tax revenue stream that has been afforded to other municipalities in New York State.
