Title of bill

An act to amend the real property law, in relation to including a condominium where the town of East Hampton or its housing authority is the holder of the landlord's interest as a qualified leasehold condominium

Purpose

Includes a condominium where the town of East Hampton or its housing authority is the holder of the landlord's interest as a qualified leasehold condominium.

Summary of provisions

Subdivision 12 of section 339-e of the real property law, as amended by chapter 234 of the laws of 2009, is amended.

Justification

The Town of East Hampton is seeking to create another affordable housing opportunity within the Town by developing a condominium complex and wants to rent said units to tenants. Under current law, the Town is precluded from such an arrangement. However, under section 339-e of the Real Property Law, there are three specific projects where this arrangement is permitted. The Town has requested to amend section 339-e to allow the Town or its Housing Authority to lease condominiums. The proposed project is 12 units, 3 buildings with 4 units each.
