Title of bill
An act to amend the insurance law, in relation to notice to insureds upon filing of a claim under a homeowners' insurance policy
Purpose
To provide a homeowner's insurance policy holders with clear written notice that filing a claim may adversely affect their premiums or the policy itself.
Summary of provisions
Section one amends the insurance law by adding a new section 3421 which requires all homeowners' insurance damage claim forms to contain a notice in plain language informing policy holders that each claim made may adversely affect their premium, the insurance policy itself or the ability to renew the policy.
Section two establishes the effective date.
Justification
Consumers who hold homeowner's insurance policies should have adequate information in order to decide whether or not to pay for any damage to their homes themselves or to file a damage claim. Homeowners should have proper notice that filing a claim may adversely affect their premiums or their policy in order to help them decide on a course of action.
