Title of bill
An act to amend the criminal procedure law, in relation to designating uniformed court officers of the town of New Windsor as peace officers
Purpose
This bill designates uniformed town court officers in the Town of New Windsor as peace officers upon the certification of the Division of Criminal Justice Services, in consultation with the Municipal Police Training Council, that such officers have received sufficient training to fulfill their duties and responsibilities in an adequate manner.
Summary of provisions
Section 1: Amends Criminal Procedure Law section 2.10 by adding a new subdivision 83 to designate such town court officers as peace officers.
Existing law
Under current law, such officers are not designated as peace officers.
Justification
This bill was requested by the Town of New Windsor Town Board. This bill was requested by the Town because the Office of Court Administration believes that many town courts have a heightened need for security personnel to protect court employees, litigants and the general public. Further, there was an incident in the nearby Village of Sloatsburg Justice Court in which shots were fired, which nearly hit the presiding justice. The OCA, through JCAP grants, has been funding metal detectors for town and village court rooms, but does not have the money to fund the personnel needed to operate such machines. Authorizing the Town of New Windsor to use peace officers for this task would increase safety in this town's court room.
