Title of bill
An act to amend the environmental conservation law, in relation to the commercial application of aquatic antifouling paints
Purpose
Removes the sunset authorizing pesticide apprentices to apply boat paints.
Summary of provisions
Removes the sunset authorizing pesticide apprentices to apply boat paints.
Justification
The continued use by the Marine Industry of pesticide apprentices to apply boat paints is essential. Due to a technical error in a 2006 statute, apprentices are no longer authorized as of December 31, 2007, to apply boat paint.
This bill will correct this error and restore the regulation and oversight by the Department of Environmental Conservation of the aquatic antifouling paint apprentice program. In this way, aquatic antifouling paint may be applied by a commercial pesticide apprentice who is employed by a business (a) working under the direct supervision of a certified commercial pesticide applicator, or (b) working under the supervision of a certified pesticide technician qualified in aquatic antifouling paints, if such application is otherwise done in compliance with the rules and regulations of the department.
This bill clarifies the law and permits the continued authorization of apprentices.
