Title of bill
An act to amend the public health law, in relation to requiring at least two qualified individuals to be present supervising a public or school pool when instructional activity is taking place
Purpose
Section 1 of this bill amends section 225 of the Public Health Law, adding a new section 5-d, requiring that additional pool staff meeting at least supervision level III must be provided when instructional activities occur.
Since 1987, five drownings have occurred at school pools in New York State. Evaluations done by the NYS Department of Health have found that these drownings occurred when supervision was only by one lifeguard/instructor who was distracted by other responsibilities and not assisted in direct supervision of the swimmers in the pool by another individual meeting Supervision Level III qualifications.
The continued loss of life in under-supervised school pools is absolutely unacceptable. This legislation requires that whenever a school pool is open, a minimum of two (2) qualified adults are present in a supervisory capacity. This will insure that if one instructor is involved in non pool supervisory activities, such as attending to students in that class not directly participating in the pool activity, another adult is in direct supervision of the swimmers.

Fiscal implications
Many school districts have already adopted this stricter standard. There would be an additional cost in hiring non instructional qualified lifeguards by those school districts which have not already adopted a two lifeguard minimum policy.
Effective date
This act shall take effect immediately.
