Title of bill

An act to amend the environmental conservation law, in relation to prohibiting the disposal of municipal solid waste generated outside of the United States

Purpose

To prohibit the delivery or municipal solid waste (including municipal solid waste incinerator ash) generated outside of the u.s. to a landfill or incinerator in the State. The owner or operator or a landfill would be prohibited from accepting the foreign waste.

Summary of provisions

Section one prohibits the disposal or municipal solid waste generated outside of the united States into a State landfill or incinerator.

Section two enacts the legislation on the 90th day following the enactment of legislation under Clause 3 of Section 8 of Article I of the constitution of the United States, authorizing prohibitions established in section one of this act.

Justification

For many years now, environmentalists and policy makers have been concerned with the amount and types of solid waste brought into New York landfills from Canada, given the potential impact on the environment and the State's precious natural resources, particularly the Great Lakes. Moreover, in an age of heightened security, there is some concern about the potentially adverse impacts the importation of Canadian trash has on state and federal homeland security efforts.

Effective date

The act shall take effect on the ninetieth day following the enactment of legislation under clause 3 of section B of article I of the US constitution authorizing prohibitions established in section one of this act, provided that the commissioner of Environmental conservation notify the Legislative Bill Drafting commission upon approval of the federal legislation by the US congress, in order that the DEC may maintain an accurate and timely effective data base of the official text of the laws of the State of NY in furtherance of effecting the provisions of section 44 of the legislative law and section 70-b of the public officers law.
