Title of bill
An act to amend the public service law, in relation to termination of service
Purpose/summary of provisions
The intent of this legislation is to protect owners and occupants from unnecessary damage caused by an avoidable termination of utility service. The bill requires that no utility may discontinue utility service to a premises where an owner has notified the utility that the customer of record is a tenant, or where the address of the customer of record differs from the address of the premises being served, unless a five day notice of impending termination has been mailed to the owner or occupant. By imposing this requirement, arrangements to continue service can be made by the owner or occupant to continue the utility service and protect the respective property interest or investment. This bill adds new subdivisions 7 and 8 to §32 of the Public Service Law. New subdivision 7 prohibits termination of utility service to a residential tenant/customer until 5 days after notice of the impending termination has been given to an owner who requested the utility to send such notices. New subdivision 8 prohibits termination of residential utility service when the customer of record's mailing address differs from the street address where service is to be terminated, unless a five day notice is first sent to the occupants of the dwelling.
Justification
The bill provides protections to all interested parties prior to an involuntary termination of utility service for non-payment of charges, or a voluntary termination of utility service at the request of the customer of record. The bill provides an opportunity for an interested party who is not the customer of record to avoid a termination of utility service, for utilities to continue to receive revenue, for tenants to maintain service, and for owners to avoid property damage.
Fiscal implications
None.
Effective date
This act shall take effect on the ninetieth day after it shall become a law.
