Title of bill
An act to amend the general business law, in relation to prohibiting the sale or rental of indecent material near a school or place of worship
Purpose
To prohibit the sale or rental of indecent materials, as defined in the penal law, within 200 feet of a school or place of worship.
Summary of provisions
The bill amends the general business law by adding a section which makes it unlawful for any person, firm or corporation to sell, offer for sale, rent, offer to rent, or display indecent material, as defined in section 235.21 of the penal law, within 200 feet of any public or private primary or secondary school, church, synagogue, or other place of worship.
Existing law
The bill amends the general business law by adding a new section 397-a. Currently, no such prohibition exists.
Justification
Under section 235.21 of the penal law, it is already a crime to distribute indecent material to minors. In keeping with the law's attempt to keep harmful material away from minors, this bill would prevent their sale, rental, or display within 200 feet of schools and places of worship. That children on their way to these places, which offer enlightenment and uplift, must encounter such materials and the establishments which peddle them is unfortunate, unseemly, and potentially damaging.
Fiscal implications
None.
Effective date
This act shall take effect on the first of September next succeeding the date on which it shall have become a law.
