Title of bill

An act to amend the real property tax law, in relation to the payment of taxes on certain state lands in the town of Ellery, in the county of Chautauqua

Purpose

The purpose of this bill is to provide for the payment of State aid to the County of Chautauqua, Town of Ellery, Maple Springs Fire Company, and the Bemus Point School District therein, with respect to State lands under the jurisdiction of the Office of Parks, Recreation and Historic Preservation located in the Town of Ellery, in the County of Chautauqua.

Summary of provisions

Section 532 of the Real Property Tax Law is amended by adding a new subdivision k.

Justification

The lands that would be the Subject of State aid payments are clearly of a statewide benefit. Situated on the beautiful Chautauqua Lake, Midway Park is recognized as the 15th oldest, Continually-operating amusement park in the nation, and one of only five remaining "Trolley Parks." This park, opening for its 108th season this year, is visited and enjoyed by numerous New Yorkers each year. Nevertheless, the impact of the current status of these lands as exempt from real property taxation falls solely on the owners of taxable real property in Chautauqua County. This bill would remedy this situation by providing State aid payments based upon the applicable local tax rater(s) in any given year, as applied against the assessments of the land on the 2005 final assessment role of the Town of Ellery in which the land is located. Payments would be made on the land now owned by the State.
