Title of bill

An act to amend the New York state defense emergency act, in relation to persons eligible to succeed the governor

Purpose

To update provisions of law that relate to the order of succession when a vacancy occurs in the office of governor.

Summary of provisions

Section 1 -- Amends the New York State Defense Emergency Act to update and expand the list of officials who may assume and discharge the duties of the office of governor in the event the office becomes vacant.

Section 2 -- Effective date.

Justification

This legislation amends the New York State Defense Emergency Act to update and expand the line of succession to the office of governor in the event a vacancy occurs. This law has not been updated since 1968, and some New York State offices referenced in that section no longer exist.

Additionally, new executive offices have been created since 1968. This proposal follows the federal model, in which new members of the federal model, in which new members of the federal cabinet appear in the line of succession to the presidency in the chronological order that their departments were created by an act of Congress.
