Title of bill

An act to amend the public authorities law, in relation to the expansion and electrification of preexisting railroad lines

Purpose

Before a preexisting railroad line which is within 1000 feet of residential property or a school is to be electrified for the purpose of expanding its service, the authority is required to hold at least one public hearing and after such hearing attain the approval of the majority of the members of the community planning board from the affected community.

Summary of provisions

Amends Section 1266 of the Public Authorities Law by adding a new subdivision 19.

Justification

Under this legislation, a community is notified about the possibility of electrification of preexisting railroad lines by means of a public hearing. (These preexisting railroad lines would be within 1,000 feet of residential property or a school.) This close proximity creates a danger to those children that live, play and attend school in that area. Because children enjoy playing on and around railroad tracks, it is necessary to alert both the parents and the children to the possible operation of preexisting railroad lines and allow for public comment. The approval by a majority of the local community planning board insures that the best interest of the community will be served.
