Title of bill

An act to amend the executive law, in relation to opportunities for utilization of minority and women-owned businesses by state agencies

Purpose of the bill

This bill would expand the State's efforts to include minority and women-owned businesses in the contracting process for improvements on real property owned by State agencies, by broadening the definition of "state contracts" to include ground leases.

Summary of provisions

Section 1 of the bill amends Executive Law § 313 to include leases by State agencies that provide for the improvement of real property by the lessees within the definition of "state contracts" for which contractors must provide opportunities for meaningful participation of minority and women-owned business enterprises.

Section 2 of the bill provides for an immediate effective date.

Existing law

Executive Law § 313, which requires state contractors to provide opportunities for meaningful participation of minority and women-owned business enterprises, currently does not cover improvements to property of State agencies pursuant to the terms of ground leases.

Statement in support

Currently, state agencies and their contractors must make an effort to include minority and women-owned businesses in the performance of their contracts. A number of State agencies use ground leases as a mechanism to develop land and provide for public improvements, rather than contracting directly for such development and improvements, but these ground lease transactions are not considered to be "contracts" subject to these minority and women-owned business opportunity requirements. This bill would require these lessees to comply with Executive Law § 313 requirements with respect to opportunities. for minority and women-owned business enterprises. Further, state agencies would be required to include such leases in their reports to the Department of Economic Development regarding the participation of minority and women-owned business enterprises in state contracts, which would better reflect the overall performance of State agencies with respect to participation of minority and women-owned business enterprises in state contracts.
