An act to amend the highway law, in relation to authorizing the placement of smoke free school zone signs

Purpose

Authorizes political subdivisions having jurisdiction over highways to permit smoke free school zone signs to be placed within the rights of way.

Summary of specific provisions

Section 1. The highway law is amended by adding a new section 318 to include smoke free school zone signs. Any political subdivision of the state having jurisdiction over any highway within school grounds, as defined in subdivision fourteen of section 220.00, may upon the request of the appropriate school authority, place, cause to be placed, or permit to be placed within the right of way of such highway signs indicating a smoke free school zone.

Justification

Secondhand smoke is a combination of smoke exhaled by a smoker and the smoke from a burning cigarette and is dangerous for both the smoker and the non-smoker. This bill would help reduce the amount of second hand smoke children ingest. Creating a smoke free zone is a commitment to protecting public health and safety by keeping the air around school grounds smoke free. Having school environment that is smoke free is important in achieving physical, mental, and social health goals for students, staff, the school and the district.
