Title of bill

An act to amend the tax law and the vehicle and traffic law, in relation to establishing the gasoline tax rebate program; and making an appropriation therefor; and providing for the repeal of such provisions upon expiration thereof

Purpose or general idea of bill

Enacts the gasoline tax rebate program; appropriation.

Summary of specific provisions

Adds a new Section 178-a to the tax law creating a gasoline tax rebate program offering New York resident income taxpayers a one-time rebate check on their state gasoline taxes in the following amounts.

Downstate (NYC and Suffolk, Nassau, Westchester, Rockland, Putnam, Orange and Dutchess Counties)

$100 for individuals with a motor vehicle registered in the State of New York whose annual income is below $90K; or $200 for couples filing jointly with a motor vehicle registered in the State of New York whose annual income is below $150K.

Upstate (All other counties)

$100 for individuals with a motor vehicle registered in the State of New York whose annual income is below $75K; or $200 for couples filing jointly with a motor vehicle registered in the State of New York whose annual income is below $125K.

Justification

Rising fuel prices are keeping many state residents closer to home during this summer's travel season but even driving to New York State's great parks and beaches can get expensive with statewide gas prices averaging well over $4.00 per gallon This legislation would help promote state tourism and give working families a much-needed economic boost by providing families earning less than $150,000 a one-time gas tax rebate of up to $200 if they own a car that is registered in New York State.

New York State addresses record gas price in 2006 with a law capping the amount of state taxes charged on gasoline, saving New Yorkers about 8 cents per gallon, but rapidly escalating prices have nullified that law's positive effects. This new gas tax relief proposal would guarantee that the gas tax savings is passed directly to the consumer.
