Title of bill

An act to amend the tax law and the state finance law, in relation to creating the "Play for the Cure" breast cancer education lottery to fund breast cancer education

Purpose

The purpose of this bill is to create the Play for the Cure scratch off lottery whose proceeds will fund breast cancer educational projects.

Summary of provisions

This bill would amend the tax law by adding a new section, 1621, which would create the Play for the Cure scratch off lottery game. The proceeds remaining after provision for prizes, expenses and contingent payment into the state lottery fund shall be deposited into the fund designated for the purposes of this bill to be expended only for breast cancer research and educational projects approved by the Department of Health and recommended by the Health Research Service Board. The game shall commence on February 15,2009 and shall be discontinued on June 13,2015.

Justification

Breast cancer attacks one in nine women and is the leading cause of death by disease in women between the ages of 40 and 54. More than 45,000 women will die this year because their breast cancer was detected too late. As you are all aware, the tragedy caused by breast cancer recently struck close to home when we lost our beloved and respected colleague, Eileen Dugan, to this terrible disease. Eileen is sorely missed and remains in our thoughts, in our prayers and in our hearts. The additional revenue generated by the Play for the Cure lottery will allow more scientific research and educational projects to be conducted and will eventually help find a cure for this disease. Additionally, this lottery will serve to raise public awareness of breast cancer and encourage more women to have mammography examinations. Breast cancer which is detected early is approximately 90% curable and having a regular mammogram screening examination will save lives, reduce medical costs and increase life expectancies.
