Title of bill

An act to amend the labor law, in relation to asbestos notification fees

Purpose

Requires that contractors who are employed by the City of Buffalo to demolish a building containing asbestos be exempt from paying an asbestos notification fee.

Summary of provisions

Section 1 amends section 904 of the Labor Law by adding a new subdivision 5 which exempts any contractor employed by the City of Buffalo for the demolition of a building that contains asbestos, including independent contractors, from paying the asbestos notification fee established under subdivision two of this section.

Justification

Under section 904 of the Labor Law, notification must be given to the State of New York of demolition activity due to air monitoring, worker safety, decontamination and disposal concerns. In turn, state government imposes a fee for this notification based on the size of the structure involved, which can be and often is as high as $1,000 per demolition. Obviously, this notification fee, which is passed through to the City by the contractor, increases the cost of demolition contracts, as well as the costs faced by the City of Buffalo when conducting their own demolition activity.

A waiver of New York's notification fee would allow the City of Buffalo to execute more demolitions and better utilize the limited amount of funding available for this purpose.

Fiscal implications

To be determined.

Local fiscal implications

During the calendar year 2006, the City of Buffalo paid to the Department of Labor approximately $200,600 in asbestos project notification fees on 158 individual projects. The Department estimates that the total value of these projects was $12,506,596. Therefore, the project notification fees paid on these 158 projects represents less than 2% of the total cost of such projects. However. the $200,600 represents approximately 7.5% of the total funding allocated to the Department's asbestos program for State fiscal year 2006-07. In addition to supporting the Department's asbestos program, these funds support other vital occupational safety and health program functions within the Department.
