Title of bill

An act to amend the legislative law, in relation to individuals who provide fiscal impact statements to the legislature

Purpose

Provides for the disclosure of which, if any, individuals or entities are involved in the attainment/creation of fiscal notes attached to retirement bills.

Summary of provisions

Section 1 amends section 50 of the legislative law to provide that, in addition to that which is currently required by statute in regards to fiscal notes submitted in relation to retirement bills, a statement identifying the individual or entity that provided compensation to the source of such estimate also be attached.

Section 2 amends section 51 of the legislative law to add a new subdivision to provide that fiscal notes shall state the estimated annual cost to the political subdivision, the source of such estimate and a statement identifying the individual or entity that provided compensation to the source of such estimate, if any.

Section 3 provides that this act shall take effect immediately.

Justification

Numerous bills are considered by the Legislature every year relating to pensions and retirement systems in New York State. As per current law, a fiscal note is required to be provided for each piece of legislation which seeks to amend any provision of law relating to a retirement system or plan in New York State.

Recently, the issue of who is providing these fiscal notes has been raised by the media. Specifically, circumstances have come to light whereby it has been revealed that an actuary on the payroll of various unions has been providing fiscal notes for pieces of legislation which would directly impact the members of those unions.

This bill seeks to provide further disclosure of who is providing the fiscal note, as well by whom that individual is being paid to do such work in an effort to provide a more open system of governance in New York State.

There is an appearance of impropriety that has gone along with this issue since this information has come to light. It is imperative that we act in a responsible way, by creating a more transparent system of governing in relation to this practice, which this bill seeks to do.
