Title of bill

An act to amend the education law, in relation to child abuse in an educational setting

Purpose

To require notification of parents and law enforcement when an allegation of child abuse in school is made, provide for automatic decertification of teachers convinced of sexual abuse of children and to provide for more training regarding child abuse in educational settings.

Summary of provisions

Section one requires that parents and law enforcement are notified automatically when an allegation of child abuse in the school-setting is made.

Section two provides for the immediate decertification of teachers upon conviction of child sexual abuse, as defined by Education Law § 1125(9).

Section three requires the commissioner to develop training materials addressing child abuse in the educational setting and that these materials be provided to school districts. This section also calls for annual in-services to review these training materials with licensed and certified staff.

Justification

School is a environment in which all of our children should be safe. Too often we hear cases of sexual abuse being perpetrated by school employees. Shockingly, under current law, parents and law enforcement are not necessarily notified that an allegation of such conduct has occurred, and a conviction of a crime directed at a child does not lead to immediate decertification of the teacher involved.
