Title of bill

An act to amend the environmental conservation law, in relation to the New York state canal flood mitigation task force

Purpose

Enacts a chapter amendment to chapter 336 of the laws of 2008 to clarify the provisions of the law regarding the appointment of members to the Citizen Advisory Board.

Summary of provisions

Section 1 amends subdivision 6 of section 73-0105 of the environmental conservation law to clarify the method of appointment of members to the Citizen Advisory Board to the New York State Canal Flood Mitigation Task Force.

Section 2 establishes an effective date.

Justification

This is a chapter amendment to chapter 336 of the laws of 2008. The current language regarding the appointment of members to the Citizen Advisory Board is ambiguous. This amendment would make it clear that the Governor officially makes all appointments, with certain members being appointed by the Governor upon recommendation of legislative leaders.

Legislative history

New bill.

Fiscal implications

None.

Effective date

This act shall take effect immediately and shall be deemed to have been in full force and effect on and after July 21, 2008; provided, however, the amendments to subdivision 6 of section 73-0105 of the environmental conservation law made by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith.
