Title of bill
An act to amend the correction law, in relation to persons who are authorized to visit correctional facilities
Purpose or general idea of bill
Relates to authorizing ministers of congregations in the county in which a correctional facility is located to visit inmates at pleasure.
Summary of specific provisions
Section 146(1) of the correction law, as amended by section 3 of part E of chapter 56 of the laws of 2005, currently states that every minister of the gospel having charge of a congregation in the town wherein a jail, workhouse or correctional facility is located to visit inmates at pleasure. The correction law will be amended by changing town to county in relation to ministers of a congregation as defined in section two of the religious corporations law.
Justification
Inmates who are in need of guidance from a minister of a congregation are limited by the current law as to who they may choose to have as their pastoral counselor because the correction law only allows those ministers within the town where the jail, workhouse or correctional facility is located to visit them at pleasure. Ministers who live within the county area have been denied access to the facilities because the current law is not comprehensive enough. Because there are not enough religious persons within the town area to meet the needs of inmates, it is necessary to expand the current law to include the county wide area.
