Sponsor's memo

Title of bill

An act to amend the education law, in relation to transferring the authority to appoint the commissioner of education from the board of regents to the governor

Purpose or general idea of the bill

To empower the Governor to appoint the education commissioner.

Summary of provisions

Amends sections 101, 302, and 303 of the education law, to allow the Governor to appoint the education commissioner on passage of a constitutional amendment allowing it.

Justification

This simple change will improve accountability and performance of the State Education Department, and allow the voters of the State to hold the state's top elected official, the Governor, responsible for the success or failure of the education system. The proposal is similar to the landmark 2002 New York City school governance reform that gave the mayor control over the city schools. All other heads of major agencies in New York are appointed by the Governor.
