Title of bill

CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to section 4 of article 5 of the constitution, in relation to the appointment of the commissioner of education

Purpose or general idea of the bill

To empower the Governor to appoint the education commissioner by and with the consent of the senate.

Summary of provisions

Amends article 4 of the constitution to allow the Governor to appoint the education commissioner by and with the consent of the senate.

Justification

This simple change will improve accountability and performance of the State Education Department, and allow the voters of the State to hold the state's top elected official, the Governor, responsible for the success or failure of the education system. The proposal is similar to the landmark 2002 New York City school governance reform that gave the mayor control over the city schools. All other heads of major agencies in New York are appointed by the Governor.
