Title of bill
An act to amend the environmental conservation law, in relation to special permits and certification for commercial application of aquatic antifouling paints
Purpose
States that social security numbers shall not appear on certain public records filed with a public entity in order to help combat identity theft.
Summary of provisions
Adds a new section 50-f to the civil rights law to state that no public entity or any officer or employee thereof shall require a person's social security number to appear on mortgages, judgments, uniform commercial code filings, death certificates, veteran's discharges, or state tax warrants. However, at its discretion they may enter into an agreement to provide a persons social security number when necessary to further the entity's official functions.
Subdivision 2 states that a public entity in receipt of a request for a record which contains a person's social security number shall reject the request if they determine that record sought could be used for any commercial, illegal or unrelated purposes. Subdivision 3 states the definition of public entity.
Section 2 is the effective date.
Justification
Identity theft is a growing concern in New York State. Unscrupulous individuals are looking for any way they can to get someone's social security number. One of these ways is to come into possession of certain documents that might contain social security numbers. This legislation is aimed at curbing the availability of these records. There is no reason that public entities should be providing the means for these individuals to steal a persons identity. By prohibiting the dissemination of information containing social security numbers we will take a step towards safeguarding our citizens. The records listed in this legislation have no need to have a social security written on them, doing so only opens up the unsuspecting individual to the possibility of identity theft.
