Title of bill

An act to amend the vehicle and traffic law, in relation to notification to the commissioner of motor vehicles of transfers of title to vehicles, and in relation to allowing bona fide transferors to rebut the presumption of vehicle abandonment

Summary of provisions

This bill amends several sections of the Vehicle and Traffic Law to require that the Commissioner of the New York State Department of Motor Vehicles maintain official records regarding the transfer of title to vehicles in this State whether or not such vehicle is re-registered within the State. In addition, this bill permits bona fide transferors to rebut the presumption of abandonment contained in Vehicle and Traffic Law Section 1224 (7) whether or not such transfer is so recorded.

Justification

During the 1989 legislative session, the serious problem of vehicle abandonment in New York State was addressed through amendments to the Vehicle and Traffic Law which: (i) increased fines for vehicle abandonment; (ii) created a rebuttable presumption that the last registered owner abandoned the vehicle; (iii) provided for license suspension in cases of failure to pay fines imposed for vehicle abandonment; and (iv) made vehicle abandonment cases in the City of New York returnable to the Environmental Control Board. While those measures have enhanced the law's effectiveness in deterring vehicle abandonment and in providing a more appropriate level of punishment, it is equally critical that an official record exist which documents vehicle transfers within the state and that bona fide transferors of vehicles are permitted to rebut the presumption of vehicle abandonment regardless of whether such transfers have been recorded by the New York State Department of Motor Vehicles.
