Title of bill

An act to amend the judiciary law, in relation to providing persons seventy years of age or older with an exemption from service as a juror

Purpose

To provide optional excuse from jury service for persons age 70 or over.

Summary of provisions

This bill adds a new section 512 of the judiciary law.

Justification

Recently a 78 year old Buffalo woman went downtown to perform jury duty. While there she slipped, fell and broke her hip. While in the hospital, she suffered a heart attack and died. When it comes to performing jury duty, there are no exemptions permitted under law. However, many seniors citizens are either frail, unable to drive or utilize public transportation, afraid of traveling downtown or simply unable to perform the duties involved with jury duty. It is difficult for a senior to get a doctor's note simply because they may be afraid. In addition, the age cap of 70 is the same as the required age in which judges must retire.

This is not an attempt to reintroduce jury duty exemptions, simply an attempt to provide senior citizens the option of declining jury duty once the local Commissioner of Jurors has called them.
