Existing law
Section 390-a of the social services law is amended by adding a new subdivision 5.
Justification
The health and safety of our children while in the care of others is of primary concern to New York State. This is clearly demonstrated by the number of new laws and regulations which have been implemented over the past few years. OCFS encourages day care providers and their staff to take the CPR and first aid courses, and they have a contract with the American Red Cross, but it is not mandatory. This legislation would make it mandatory for the operators and staff of all day care providers to be trained and certified in CPR and first aid. Accidents are the leading cause of death among toddlers and children. Included in the classification of accidents are choking, electrocution, drowning, and other trauma. It has been shown that if CPR is started immediately after such trauma it can, besides possibly saving a life, prevent brain damage in those who survive. It is essential that we protect our children as much as we possibly can, and part of that protection is making sure that the professionals caring for them are adequately trained to deal with as wide a range of situations as possible.
