Title of bill

An act to amend the racing, pari-mutuel wagering and breeding law, in relation to providing that certain associations or corporations that permit any persons under the age of eighteen to bet on a horse race shall be guilty of a misdemeanor

Purpose

To make an employee of a licensed association or corporation who permits a person under eighteen years of age to bet on a horse race guilty of a misdemeanor.

Summary of provisions

The bill would amend section 104 of the racing, pari-mutuel wagering and breeding law, as amended by chapter 919 of the laws of 1986, to provide that no licensed association or corporation shall permit any person who is actually and apparently under eighteen years of age to bet on a horse race, nor shall such person be permitted to bet at an establishment of a regional corporation conducting off-track betting. Specifically, the bill provides that any employee of a licensed association or corporation who permits or offers to permit any person who is actually and apparently under eighteen years of age to bet on a horse race shall be guilty of a misdemeanor.

Justification

In recent years, the problem of teenage gambling has rivaled drug abuse as a social concern. One study by the Harvard Medical School found that between 6.4 and 8.5 percent of suburban Boston high school students surveyed were classified as compulsive gamblers. This bill addresses the problem by punishing employees of licensed associations or corporations who permit underage gambling to take place.
