Title of bill

An act to amend the tax law and the state finance law, in relation to prohibiting the use of lottery funds for advertising, marketing or promoting the lottery

Purpose

This bill would prohibit the use of lottery revenues for the purpose of promoting the lottery.

Summary of provisions

Section 1 of the bill amends Tax Law Section 1612(c) to prohibit the use of revenues collected from the lottery for the purposes of advertising, marketing or promoting the lottery.

Section 2 of the bill amends State Finance Law Section 92-c(3) to prohibit the appropriation or transfer of funds from the lottery fund for the purpose of advertising, marketing or promoting the lottery.

Justification

The New York State Constitution provision authorizing the operation of the lottery by the State requires that the net proceeds thereof be applied exclusively to or in aid or support of education in the State. Additionally, the State Finance Law provides that the moneys in the lottery fund shall be appropriated or transferred solely for education after the repayment of first instance expenditures incurred in the operation of the lottery.

This legislation seeks to prohibit the questionable use of lottery revenues, thereby preventing the enormous depletion of funds available for education which is presently occurring.

Fiscal implications

There should be an increase in funds available for education.

Effective date

This act shall take effect on the thirtieth day after it shall have become a law and shall apply to all revenues collected as a result of the New York State lottery for education occurring on or after such date.
