Title of bill
An act to amend the real property tax law, in relation to exempting from real property taxation real property owned by a person certified to receive a United States department of veterans affairs disability pension
Purpose or general idea of bill
Exempts from real property taxation real property owned by a person certified to receive a United States department of veterans affairs disability pension.
Summary of specific provisions
This bill amends Section 459-c (2) (b) to add the receipt of a United States Department of Veterans Affairs disability pension and the letter one receives, is evidence that the person is disabled and has limited income.
Effects of present law which this bill would alter
Existing law recognizes several forms of proof of disability, but does not specifically recognize a veteran's disability pension. This bill simply adds further clarification to the existing law without altering the actual definition of a person with a disability and limited income.
Justification
This section of law was recently amended by Chapter 421 of the Laws of 2000 to include the receipt of a U.S. Postal Service Disability Pension as qualifying proof of disability. This bill adds the veteran's disability pension pursuant to 38 U.S.C. section 1521 to the list of approved persons who are eligible to receive this exemption.
The VA Disability Pension is a benefit to wartime veterans with limited income who are no longer able to work. One may be eligible if they were discharged from service other than dishonorable conditions, served 90 days or more of active duty with at least 1 day during a period of war, have disabilities that keep you from working a regular, full-time job and the countable family income is below a yearly limit set by law.
