Section 1. Amends section 10.00 of the penal law by adding three new definitions. 21. "School grounds" 22. "Child day care center" 23. "Place where children congregate"
Section 2. Requires that as a mandatory condition for sex offenders, the sentenced offender shall refrain from knowingly entering into or upon any school grounds, child day care center, or any place where children congregate.
Section 3. Any person registered pursuant to Article 6-C of the Corrections Law shall refrain from knowingly enter into or upon any school grounds, child day care center, or any place where children congregate.
Section 4. Violations of this article shall result in a Class A misdemeanor for the first offense, and a Class D felony for each subsequent offense.
Justification
The purpose of this bill is to address the valid concerns of parents across the state. Sex offenders pose a dangerous threat to society. This legislation is intended to protect children by prohibiting all registered sex offenders from stepping within a certain proximity of school grounds, child day care centers, or any places where children congregate.
This legislation would prevent a registered sex offender from knowingly step within 1000 feet from a public or private school, child care center, or place where children congregate, in cities with a population of one million or more; and within 1500 feet in all other counties.
